1. Platform Overview & Scope

Welcome to ServiceMedium ("Platform", "we", "us", or "our"). ServiceMedium is a decentralized discovery platform and portfolio marketplace operating in India. Our primary mission is to connect clients directly with skilled professionals, freelancers, and agency providers with 0% platform commission on direct engagements.

By accessing, browsing, registering an account, or creating listings on ServiceMedium, you agree to be legally bound by these Terms of Service, our Privacy Policy, and applicable Indian laws including the Information Technology Act, 2000, and the Digital Personal Data Protection Act (DPDPA), 2023.

2. User Accounts & Verification

• Eligibility: You must be at least 18 years of age to register an account or offer services.
• Account Accuracy: You agree to provide truthful, accurate, and current information regarding your professional credentials, portfolio samples, and contact channels.
• Account Security: You are responsible for safeguarding your login credentials. You must immediately notify ServiceMedium of any unauthorized account access.

3. Service Listings & Provider Conduct

Service providers retain full autonomy over their pricing, turnaround timelines, and client agreements. When publishing services or visual portfolio works on ServiceMedium:

• You warrant that you own or have obtained all necessary licenses for media, designs, logos, and trademarks displayed in your profile or portfolio.
• You shall not misrepresent your skills, display fraudulent testimonials, or post misleading service prices.
• ServiceMedium does not act as an escrow agent or employer. Contracts entered into between clients and providers are strictly bipartite agreements between those parties.

4. Prohibited Content & Zero-Tolerance Violations

Users may not upload, publish, or transmit content that:

• Contains sexually explicit, pornographic, or non-consensual imagery.
• Promotes hate speech, violence, harassment, or defamation against individuals or groups.
• Involves unauthorized collection, scraping, or spamming of contact information revealed through the platform.
• Distributes malicious software, viruses, or attempts unauthorized access to platform infrastructure or APIs.

Enforcement Notice: Violations will result in immediate account suspension, permanent ban, removal of all public listings, and referral to relevant law enforcement authorities where legally required.

5. Contact Reveal & Anti-Scraping Policy

To protect service providers against automated scrapers, cold-call telemarketers, and spam bots, direct contact information (phone number, WhatsApp, direct email) is protected behind an intentional "Reveal Contact" mechanism subject to persistent IP and user rate limiting. Mass scraping or automated extraction of revealed contact details is strictly prohibited and constitutes a breach of these Terms.

6. Reviews & Feedback Authenticity

Clients may submit ratings and written reviews for providers. Reviews must reflect genuine commercial interactions. Service providers are prohibited from submitting self-reviews or paying third parties for artificial ratings. ServiceMedium reserves the right to moderate or delete fraudulent or abusive reviews.

7. Limitation of Liability & Dispute Resolution

ServiceMedium provides discovery and indexation services on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee the performance, legal compliance, or quality of work delivered by independent service providers. Any disputes arising from service fulfillment must be settled directly between the client and provider.

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising hereunder shall be subject to the exclusive jurisdiction of the courts located in West Bengal, India.
